Abstract

Waqf is one of the instruments used to promote the welfare of the people. The economic aspect contained in the waqf institution requires professional human resources and integrity in managing waqf so that the goals and objectives of the waqf designation are achieved. The waqf manager, referred to as nazhir, in the perspective of the majority of scholars and the waqf law is a pillar that causes the validity or invalidity of waqf legal actions. Nadzir is authorized by the Law to manage and develop waqf assets as stipulated in Article 11. However, it is often found that nadzir cannot carry out their duties properly, resulting in a deficit or even loss of waqf assets. The method used in this research is the normative juridical method using a legal norms approach. Data is collected based on literature review in the form of application of good governance principles and legal utility theory. This type of qualitative research is conducted by interpreting legal materials comprehensively and systematically so as to produce conclusions. The results showed that the waqif could not change the nazir without the permission of the Indonesian Waqf Board (BWI). However, what a waqif can do is make a report to BWI and recommend a replacement nazir candidate.
