Abstract

This study aims to analyze the existence of customary inheritance law in the Baduy community and examine the mechanism for resolving inheritance disputes through deliberation and the indigenous value of silih hampura. The study employed a normative juridical approach using statutory and conceptual analysis based on legal documents and scholarly literature concerning customary law, inheritance, and dispute resolution. The findings indicate that Baduy customary inheritance law functions as a form of living law rooted in pikukuh, kinship values, and communal legitimacy. Inheritance disputes are generally resolved through a gradual process involving dispute identification, family deliberation, mediation by customary leaders, agreement on property distribution, and reconciliation through silih hampura. The study found that silih hampura serves as the ethical foundation of dispute resolution by promoting mutual forgiveness, emotional healing, and restoration of social harmony. These findings contribute to the discourse on legal pluralism and restorative justice by demonstrating that indigenous legal values can function as effective mechanisms for dispute resolution while preserving social cohesion and cultural continuity.
